How do natural rights become negative liberties protected by positive law?
We start with the natural right to privacy, how it evolved under the common law, from Magna Carta to the fourth amendment.
We also look at how the fourth amendments failure to secure privacy is not the result of modern government surveillance in the digital age outpacing the law’s ability to adapt, but instead is a cause of fundamental misconceptions of the original meaning of Amendment IV.
